How to post bail in Georgia, start to finish

Nobody reads this page on a good day. So here is the whole sequence in order, with the parts that actually cost people time marked out, and no filler in between.

The sequence

1
Locate the booking
2
Wait for the bond to be set
3
Choose cash, property or surety
4
Co-signer signs
5
Bond posted at the jail
6
Release — usually 2–6 hours

Step one: find out where they actually are

Start with the county, not the city. Georgia books arrests into county detention facilities, and city police departments generally do not run their own jails. An arrest by Cumming PD lands in the Forsyth County Jail. An arrest in Johns Creek lands in Fulton County.

If an inmate search shows nothing, it is usually because booking has not finished. Intake — search, property, medical screening, prints and photograph — can run a couple of hours before a record posts. Refreshing a page does not speed it up. A phone call to someone who does this daily does.

Step two: the bond has to be set before anything can happen

This is where most families lose an evening to frustration, so it is worth being blunt: until a judicial officer sets a bond amount, there is nothing to post. No amount of money, urgency or persuasion changes that.

Some charges carry a preset bond schedule and the amount is known at booking. Everything else waits for first appearance, which Georgia requires within 48 hours of a warrantless arrest or 72 hours where a warrant was issued. In Forsyth County that hearing is held in Magistrate Court on Tribble Gap Road.

An arrest late on a Friday night is the worst case, because the calendar may not reach them until Monday morning. It is also exactly the situation where knowing what is happening beats sitting in a car park hoping.

Step three: choose how to post it

OptionWhat you pay nowSpeedComes back?
Cash bondThe full bond amountFastMostly, at case end
Property bondNothing, but you pledge real estateDaysLien released at case end
Surety bond15% premiumFastNo

A cash bond ties up the whole amount for the life of the case — often many months — and Forsyth County generally accepts cash only, not cheques. A property bond is real but slow, needing a deed, a current valuation, proof of equity and a judge’s approval. A surety bond costs 15% of the bond and it is gone, but it is the option that works at midnight.

Step four: the co-signer

Somebody has to guarantee the appearance. That person needs valid photo identification, a verifiable address and phone number, and usually some evidence of stability — employment, residence, ties to the area.

Understand what is being signed. The co-signer is liable for the full face value of the bond, not the premium, if the defendant fails to appear, plus reasonable costs of recovery. We will read that part out to you rather than letting you find it later.

Signing can be done in person at our office at 110 Samaritan Drive, Suite 112 in Cumming, or remotely by email. Remote is normal and it does not slow the release.

Step five and six: posting, and waiting

We take the executed paperwork to the jail. From there it is a queue again: verification, paperwork processing, property return, and release. Two to six hours is the honest range at the Forsyth County Jail. Shift changes, a full weekend, a medical hold or a warrant in a neighbouring county all extend it.

Then the conditions start. Every court date, every reporting requirement, every no-contact order. Read them, put the dates in a phone, and call us if anything changes.

Common questions

Questions we get asked about this

Can I post bail before a bond amount is set?

No. A judicial officer has to set the amount first. Some charges have preset bond schedules; the rest wait for first appearance within 48 to 72 hours.

How much money do I need tonight?

For a surety bond, 15% of the bond amount, with a $50 minimum per bonded charge. A $5,000 bond costs $750. A cash bond would require the full $5,000.

Who can be a co-signer?

Someone with valid photo ID, a verifiable address and phone, and reasonable stability. They take on liability for the full face value of the bond if the defendant fails to appear.

Can everything be done remotely?

Largely, yes. Co-signers routinely sign by email. Only the bond itself has to be physically posted at the jail, and that is our job, not yours.
