A DUI arrest in Georgia is a bail-restricted offence. There is no signature bond — release has to come through cash, property or a surety. We post DUI bonds at the Forsyth County Jail at any hour of the night.
Georgia treats driving under the influence as a bail-restricted offence. That is not a policy your bondsman chose and it is not something the jail can waive at 4 a.m. It means the person in custody cannot simply sign a promise to appear and walk out — a judge has to set a secured bond, and somebody has to post it.
In practice that leaves three doors. You can pay the full bond in cash directly to the Forsyth County Jail and get most of it back at the end of the case. You can pledge real property, which works but takes days. Or you can use a licensed surety — a bail bondsman — who posts the full amount on your behalf for a premium capped by statute at 15%.
For most families the third door is the only realistic one at two in the morning, which is exactly why we answer the phone at two in the morning.
Bond amounts on a first-offence misdemeanor DUI in Forsyth County commonly land somewhere between $1,000 and $5,000, though the judge sets the number and there is no fixed tariff. Aggravating facts push it up fast: a wreck, an injury, a child in the car, a refusal, a prior conviction inside ten years, or a felony charge such as serious injury by vehicle or habitual violator.
| Bond set at | Your premium at 15% | Refundable? |
|---|---|---|
| $1,000 | $150 | No |
| $2,500 | $375 | No |
| $5,000 | $750 | No |
| $10,000 | $1,500 | No |
That premium is the whole cost of the bond itself. It is not a deposit and it does not come back if the case is dismissed — it is the price of us assuming the risk for the full face value. Anyone quoting you more than 15% is breaking the law, and anyone quoting far less should be asked what they are leaving out.
Getting out is step one. The bond order usually carries conditions, and breaking one of them can land the person right back in custody with the bond revoked.
Have as much of this as you can when you call. If you only have a name, call anyway — finding the rest is our job.
A co-signer can sign in person at our office on Samaritan Drive or remotely by email. Once the paperwork is signed we carry it to the jail and the release clock starts. At the Forsyth County Jail that clock usually runs two to six hours depending on the shift and how busy booking is.
Common questions
Yes. Driving under the influence sits on the bail-restricted list under O.C.G.A. § 17-6-12, which means release requires a secured bond — cash, property or a surety — rather than a signature or unsecured bond.
A first-offence misdemeanor DUI commonly runs $1,000 to $5,000, but the judge sets the number. A wreck, an injury, a refusal, a child in the vehicle or a prior conviction can push it well past that. Our premium is 15% of whatever the judge sets.
Yes. The Forsyth County Jail books and releases around the clock and so do we. The limiting factor is usually whether a bond has been set yet, not the hour.
Georgia suspends a licence administratively after a DUI arrest unless a hearing is requested within a short window. That is a legal question for a defence lawyer, not a bondsman — but do not let the deadline pass while you wait.
No. The premium pays for the risk we take on the day we post the bond, so it is earned whatever the case does afterwards. A cash bond posted directly to the jail behaves differently and is largely refundable at the end.
